COMPREHENSIVE CHILDCARE ASSOCIATES NOTICE OF PRIVACY PRACTICE

 

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOUR CHILDREN MAY BE USED, DISCLOSED AND HOW YOU THE PARENT MAY ACCESS TO THIS INFORMATION AT COMPREHENSIVE CHILDCARE ASSOCIATES (CCA). PLEASE REVIEW IT CAREFULLY

Permissible Uses and Disclosure Without Your Written Authorization
Your child's health information maybe used by staff members or disclosed to other health care professionals for the purpose of evaluating your child's health, diagnosing medical conditions, and providing treatment. For example, results of laboratory tests and procedures will be available in your medical record to all health professional who may provide treatment or who may be consulted by staff members. Protected health information means information including demographics, past, present, or future physical condition, payment for providing health care to an individual and identifies the individual. We may use and disclose PHI (Protected Health Information) in order to treat your child, obtain payment for services provided to your child and conduct our health operations as detailed below.

Payment
Health information may be used to seek payment from your health plan or other companies that you may use for health care services. For example, your health plan may request and receive information on dates of service, the services provided and the medical condition being treated.

Health Care Operations
Information on services your child has received may be used to support budgeting, financial reporting, and activities to evaluate and promote quality of care.

Disclosure to Relatives and Childcare Providers
We will do our best to only disclose medical information to Guardian Parents and those listed at the end of this document. If you the parent are not present, or in an emergency, we may exercise our professional judgment to determine whether this disclosure of medical information is in your child's best interest. If we disclose information to a family member, nanny or other caregiver, we will only disclose information that is directly relevant to the person's involvement at that time with your child's health care.

Law Enforcement
Health information may be disclosed to law enforcement agencies without parent's permission to support government audits and inspections, to facilitate law enforcement investigations, and to comply with government mandated reporting.

Public Health Reporting
Health information may be disclosed to public health agencies as required by law. For Example: Certain communicable diseases to state public health department.

Victims of Abuse, Neglect or Domestic Violence
It is State Law that we report all reasonable suspicion of sexual or physical abuse, neglect or domestic violence to the proper authorities with or without your permission. We may disclose personal health information about your child to government authorities including social service or protective services agencies authorized by law to receive reports of such abuse, neglect, or domestic violence.

Health Oversight Activities
We may disclose personal health information to a state recognized health oversight agency with the responsibility for ensuring compliance with the rules of governmental health programs such as Medicaid, Watch or Staywell.

Judicial and Administrative Proceedings
We may disclose personal personal health information in the course of a judicial or administrative proceeding in response to a legal order or other lawful process.

Decedents
We may disclose personal health information to a coroner or medical examiner as authorized by law.

Health or Safety
We may disclose personal health information to prevent or lessen a serious and imminent threat to a person's health or safety.

ADDITIONAL USES OF  INFORMATION

Appointment Reminders
Health information is used by our staff to send and call you with appointment reminders.

Mail
CCA may mail to your home or other designated location any items that assist the practice in caring out your child's care, such as appointment reminders, insurance items and statements for your account balances.

Individual Rights
You have certain rights under the federal privacy standards. These include:

The right to request restrictions on the use and disclosure of your child's protected health information
The right to receive confidential communication concerning your child's medical condition
The right to inspect and copy your child's protected health information
The right to amend or submit corrections to your child's health information
The right to receive an accounting of how and to whom your prospected health information has been disclosed
The right to receive a printed copy of this notice

All requests for access must be made in writing. Under limited circumstances we may deny you access to your child's records. If you desire access to your child's records, you will need to obtain a record release request form from our front office staff. Once completed submit it to the front desk. In most cases, your copies will be given to you within 30 days of your request. This 30 day period can be extended for another 30 days if you are given a reason. There are charges for retrieving, coping and mailing medical records. Please ask the front staff for the current charges.
You should take note that under Florida State Law certain portions of your child's records will not be available to you without written permission from them when they turn 18 years old.

The Right to Revise Privacy Practices
As permitted by law, we reserve the right to amend or modify our privacy policies and practices. These changes may be required by federal and state laws and regulations. You will receive notice of these changes upon your request on your next office visit. The revised policies and practices will be applied to all protected health information that we maintain.

Request to Inspect Protected Health Information
As permitted by federal regulation, we require that request to inspect or copy protested health information be submitted in writing. Our office has the right to refuse medical information request which we feel will complicate or potentially interfere with providing health care. We will inform you of such refusal.
